EU Consumer Rights and Product Safety: Returns, Guarantees and Traceability

The 14-day withdrawal right, the two-year conformity guarantee, and the product-safety information every listing must now carry to be sold in the EU.

Three EU rules shape what an online store must offer: consumers can withdraw from most distance purchases within 14 days without a reason; goods carry a legal guarantee of conformity for a minimum period after delivery; and products sold into the EU must be traceable, with an identifiable economic operator established in the Union responsible for them. All three are enforceable, and all three are cheaper to build in than to retrofit.

1. The 14-day right of withdrawal

Consumers may cancel most distance purchases within 14 days of receiving the goods, without giving a reason.

What you must do:

  • Inform the buyer of the right before the order. Failing to do so extends the withdrawal period substantially — this is the expensive mistake.
  • Provide a way to exercise it and confirm the terms in durable form after purchase.
  • Refund within the statutory deadline once you receive the goods back or proof of return.

What you may do:

  • Require the customer to pay return postage, if you told them clearly in advance.
  • Deduct for diminished value where the buyer handled the goods beyond what is needed to assess them.

Genuine exceptions include made-to-measure or personalised goods, sealed goods unsuitable for return once unsealed for health or hygiene reasons, perishables, and sealed audio/video or software once unsealed. List your exceptions explicitly. A blanket "no returns" is unenforceable and reads as a warning sign.

2. The legal guarantee of conformity

Separately from withdrawal, goods must conform to the contract. If they do not, the consumer has remedies — repair or replacement first, then price reduction or termination — for a minimum period after delivery, with a reversed burden of proof for an initial window.

Two practical points:

  • This is not your commercial warranty. A commercial warranty is additional. Never present the statutory minimum as a generous extra; informed consumers notice.
  • Describe accurately. Most conformity disputes are description disputes. Precise specifications reduce claims more than any policy wording.

3. Product safety and traceability

The EU's general product safety framework requires, for products sold to EU consumers, that there is an economic operator established in the EU responsible for the product, and that certain information appears with the offer. In practice, your listings should carry:

  1. Manufacturer's name and contact details.
  2. The EU responsible person, where the manufacturer is outside the EU.
  3. Product identifiers — model, type, batch, and an image.
  4. Warnings and safety information in the language of the country of sale.

The commercial consequence for non-EU sellers is significant: if you manufacture or import from outside the EU, you need an EU-established responsible person before you can lawfully offer the product. Marketplaces enforce this. See selling from the Gulf into Europe.

Certain categories carry additional duties — electricals, batteries, toys, cosmetics, food-contact materials — and packaging or product take-back obligations apply in many member states, as in France and Germany.

Turning compliance into conversion

The same information that satisfies a regulator reassures a buyer:

  • A clear returns page reduces pre-purchase hesitation more than a discount does.
  • Precise specifications reduce returns and rank better, because they match how people search.
  • Visible manufacturer and safety information signals a real business.

Stores that treat these pages as legal boilerplate hide them in the footer. Stores that treat them as sales assets link to them from the product page.

Frequently asked questions

Do I have to pay return shipping?

Not necessarily — you can require the customer to pay it, provided you clearly informed them before the purchase. Many sellers absorb it anyway because it lifts conversion.

Does the 14-day right apply to digital products?

Different rules apply to digital content, especially once supply has begun with the consumer's express consent. Handle it separately from goods.

What if the customer used the item?

They may handle goods to assess them as they would in a shop. Beyond that, you may deduct for diminished value.

Do these rules apply to me if I am outside the EU?

Yes, when you target EU consumers. Product traceability in particular requires an EU-established responsible person.
