Selling Online in the UK: VAT, Consumer Law and Post-Brexit Imports

The UK is outside the EU customs union and VAT area, which changes everything for cross-border sellers. Registration, the 14-day right, delivery habits and what converts.

Since leaving the EU, the UK is a separate customs and VAT territory — an EU seller shipping to Britain is now exporting, with customs declarations, potential import VAT and duty, and separate UK rules on consumer protection and product compliance. Plan it as its own market, not as an extension of your European one.

VAT: the rules that catch sellers out

Two things matter most for a cross-border seller:

  1. UK VAT registration. A UK-established business registers once its taxable turnover passes the registration threshold. Businesses established outside the UK have no such threshold for taxable supplies made in the UK — the obligation can arise from the first sale. This is the single most misunderstood point for foreign sellers.
  2. Consignments below the low-value threshold. For goods sent to UK consumers in consignments under the low-value limit, the seller is generally responsible for charging and accounting for UK VAT at the point of sale rather than VAT being collected at the border. Above it, import VAT and duty apply on entry.

Get advice specific to your setup, and confirm current thresholds with HMRC — the details change and the penalties for guessing are real.

Consumer law

The UK retains a consumer-protection regime broadly similar in shape to the EU's:

  • A 14-day cancellation right for most distance sales, with the usual exceptions.
  • Statutory rights on goods being of satisfactory quality, fit for purpose and as described — including a short-term right to reject.
  • Clear pre-contract information: total price, delivery cost, delivery timing, your identity and contact details.

State your terms plainly and honour the statutory rights without argument; UK consumers are well informed about them.

What UK buyers expect operationally

  • Fast, tracked delivery as standard. Next-day is common and often expected on higher-value orders.
  • Easy returns. Free returns are a competitive norm in fashion, though not a legal requirement.
  • Clear, all-in pricing. Surprise charges at checkout are the top abandonment cause. If you ship from outside the UK, make it unmistakably clear whether duty and import VAT are included. A customer hit with an unexpected courier handling fee will not order again.
  • Card and wallet payments. Cards dominate, digital wallets are heavily used, and buy-now-pay-later is mainstream.

Selling into the UK from outside

If you ship from the EU, the Gulf or anywhere else:

  1. Decide DDP or DDU, and say so. Delivered-duty-paid costs more but removes the doorstep surprise. For consumer sales, DDP converts far better.
  2. Get your commodity codes right. They determine duty. Wrong codes mean delays and unexpected bills.
  3. Expect longer delivery times and communicate them honestly.
  4. Check product compliance separately. UK conformity requirements are their own regime; do not assume EU marking is sufficient for everything.

If you are established outside the UK and making taxable supplies there, quite possibly from the first sale — the domestic threshold does not apply to you. Take advice early.

Can I sell to the UK and the EU from one store?
